Request to Deviate from the Ontario Electrical Safety Code

How do I know the status of my deviation request?

The applicant will receive automated emails when the request is moved from the initial review to the technical review, at which stage a deviation request number will also be assigned. 

If a request is not accepted, do I still have to pay?

Yes, the fee is to cover the cost of reviewing the request and is independent of the outcome.

Who can sign for the owner if it is a large company?

An authorized representative of the company who is responsible for the project and can validate the objectives of the relevant project, can sign the Deviation Request Form. 

If the request is not approved are there any other options?

The applicant can decide to either alter the design to comply with the requirements of the OESC or in some situations explore a different method to achieve the intent of the OESC. If a deviation request is declined, a subsequent request for that installation would be treated as a new request and would need to follow the process including fees associated with new submissions. 

I do not have an account with ESA, can I still apply for a deviation?

Before applying for a deviation, you must have a valid ESA customer account. Call ESA at 1-800-746-6480 for assistance with opening an account.

If the deviation is accepted, does it expire?

No, the deviation becomes a part of the installation that it is associated with for the rest of its life. For this reason, the submitted requests and review results are retained by ESA for reference at any point in the future. 

Can I use a previously accepted request for another job with the same OESC non-compliance issues?

No, deviations from the OESC are site and project specific. If a deviation was accepted for a specific site, it cannot be extended to other similar projects at the same or other sites. 

Can someone else submit the form for the applicant?

No, the applicant must be the related notification holder and submit the form themselves. To ensure continuity of the information exchange and the accuracy of the review, ESA will only request and/or share information with the applicant.
